    Tentative Deal Reached for Condo Collapse Victims

    Attorneys reached a tentative deal to pay $83 million to people who had personal property losses from the Champlain Towers condo collapse. The full, written agreement will be ready to file in court by next Thursday, according to attorneys involved. It will still need approved by Miami-Dade Circuit Judge Michael Hanzman, who is presiding over the lawsuits stemming from the condo collapse.

    The lawsuit contended that work on the Eighty Seven Park tower, which was adjacent to Champlain Towers South, damaged and destabilized a building that was already in need of major structural repair. The condo collapsed without warning, destroying dozens of condos and burying 98 victims in debris and rubble.

    This agreement will affect those involved in the property owner’s group. Those who accept the agreement will be finished with the case and free from a potential assessment for condo associations to cover legal costs.

    This agreement will not resolve the lawsuit claiming damages for wrongful death. Multiple families have filed a lawsuit against the condo association’s board, alleging that the condo association and other liable parties knew or should have known about the structural problems but failed to repair them, resulting in wrongful death. The plaintiffs have cited a 2018 engineering report that listed major structural damage in the garage and pool areas and recommended immediate repairs needed. The wrongful death lawsuit has a potential to reach a remedy of $120 million or more from the sale of the property and an additional $30 in estimated insurance settlements. The property is scheduled for auction in late April.
