As part of the an ongoing action by the state to crack down on neglectful nursing home care, the Pennsylvania Attorney General’s Office has filed an Amended Complaint to include Golden Living Center in Exeter Township, Berks County. The lawsuit alleges Golden Living engaged in deceptive and unlawful business practices. The Commonwealth of Pennsylvania is demanding that the nursing home pay $1,000 per violation of the law, and up to $3,000 for every violation involving a person 60 years old or older.
By way of history, on July 1, 2015, the PA Attorney General, Kathleen Kane, took legal action against Golden Gate National Senior Care LLC, a nursing home chain operating 36 homes throughout Pennsylvania. The crux of the complaint is that the Texas based nursing home chain willfully failed to adequately staff its nursing homes which resulted in improper healthcare to residents and enormous profits to the nursing home chain. In doing so, it violated Pennsylvania’s unfair trade practices act, as the PA nursing home lawyers know.
Attorney General Kathleen Kane has stated that:
“These facilities promised to provide the care needed by residents and then failed to meet residents’ most basic human needs. That is simply unacceptable.”
Investigations by the state have found violations including leaving residents in soiled diapers, putting residents at risk of bedsores, and failing to help nursing home residents with basic living needs, such as using the bathroom and showering. It is alleged that these nursing home facilities left residents hungry and thirsty. It is also alleged that Golden Gate nursing facilities fraudulently falsified patient records.
