    New Jersey nursing homes that receive federal funding are required to meet the criteria set forth in the Federal Nursing Home Reform Act, or FNHRA.  Under this law, elderly residents must receive proper care to promote their “highest practicable” mental, physical, psychological, and social health.     Common Warning Signs of Elder Abuse and Caregiver Neglect

    If you suspect your elderly loved one has been physically, mentally, or even financially harmed at an elder care facility, you should consult with an experienced attorney who can investigate the matter in depth.  In particular, you should file a complaint with the New Jersey Department of Health and contact Brent immediately if you suspect or witness any of the following:

    • Verbal abuse directed at a resident.
    • Medication errors, including negligent or intentional overmedication.
    • Physical abuse such as pushing, slapping or hitting a resident.
    • Failure to offer proper medical attention, such as CPR.
    • The occurrence of wrongful death.  Wrongful death is broadly defined as any avoidable death resulting from another party’s negligent, reckless, careless, or illegal actions (or failure to act).
    • Maintaining an unsafe living environment.  Examples include tripping hazards or unprotected heating units next to a bed, which can contribute to accidental falls.
    • Failure to provide adequate nutrition and/or hydration.
    • Failure to assist residents with bathing and/or bathroom necessities.

    There are also certain warning signs which tend to indicate improper treatment.  Many of the claims Brent handles involve one or more of the following “red flags”:

    • Bed sores, which are also called pressure ulcers or decubitis ulcers.
    • Frequent nursing home falls resulting in serious injury.
    • Unusual or sudden changes in behavior, such as your loved one becoming fearful of the home, or becoming hesitant to speak in front of staff.
    • Unsanitary conditions, such as residents left in soiled diapers, which generally indicate neglectful elder care.
    • Unexplained injuries, wounds, or bruises.
    • Chronic infections and/or frequent bouts of illness.
    • Dehydration and/or malnutrition, typically seen together.  These often present with rapid weight loss or gain.
    • Unexplained or unexpected emergency room treatment or death.
